ABSTRACT
The main objective of this study was to design a critical-legal analysis document on money
laundering in Ecuadorian legislation and its impact on the Ecuadorian commercial, corporate and
tax legal framework. The methodology was qualitative in nature through a documentary analysis
based on the examination of current legislation, reports issued by government agencies and non-
governmental organizations, academic publications and other relevant materials. The results
indicate how money laundering not only affects the economic and financial stability of Ecuador,
but also negatively impacts the social and business development of the country. The evolution of
the legal framework, reflected in the adaptation of the Comprehensive Criminal Organic Code
(
COIP) and other relevant legislation, shows a commitment on the part of the Ecuadorian State
to align itself with international standards and address this challenge in a comprehensive manner.
It concludes on the importance of effective international cooperation and the implementation of
advanced technologies to improve the ability to detect and prevent money laundering activities.
Furthermore, the need for active and conscious participation by Ecuadorian society is recognized
to counteract this phenomenon, promoting transparency and integrity in the financial system and
in the business environment.

1. INTRODUCCIÓN
El lavado de activos es considerado un delito en Ecuador, que implica la
obtención de recursos a través de operaciones ilícitas como el narcotráfico, la
trata de personas, el terrorismo y el contrabando, entre otros. Además, se
extiende a delitos más sofisticados como la defraudación fiscal, el peculado, el
cohecho, la concusión y el enriquecimiento ilícito, principalmente cometidos por
servidores públicos que abusan de su posición para cometer estos actos.
Los fondos generados por estas actividades ilícitas buscan ingresar al sistema
financiero de manera regular, pero también desaparecen repentinamente. Una
estrategia común para integrar estos capitales en la sociedad es a través de la
creación de nuevos negocios o la inversión en empresas ya existentes. Estos
negocios, ya sea por necesidad, falta de inversión o apoyo gubernamental,
pueden verse tentados a recurrir a estas prácticas para no perder sus recursos.
Guerrero Luzuriaga et al. (2019) señalan que las inversiones ilegales o
realizadas al margen de la ley tienen un impacto aparentemente positivo al
inyectar capital y estimular la reactivación económica, particularmente a través
de pequeñas y medianas empresas. Estas entidades, incluidas las empresas
familiares y las dedicadas al sector inmobiliario, junto con individuos
