Abstract

The law is a factor that prevents illegal actions and a kind of motivator to avoid illegal behavior. The question of establishing a reliable link between the action of the defendant and the damage caused determines the repair of the damage and is a preventive means to avoid legal problems. Legal responsibility can be seen as a response to a certain situation and as a means to force the party that caused the damage to compensate it, as well as to guarantee compliance with established norms and rules to avoid further violations. In that sense, civil liability is the obligation of the person who caused the damage to suffer damages, which would be expressed in the form of compensation for the damage caused or other negative restrictions of property for the offender in violation of civil law and have in order to prevent recurrence. The objective identification of a specific person who intentionally or negligently caused the crime significantly affects the achievement of the truth. In this sense, the objective of this review lies in compiling various perspectives of the current paradigm of legality from the legal context.
